"David Finnerty was wrongly convicted in October 2006 of securites fraud. Finnerty filed a post-trial motion to overturn the juries verdict on the basis that the government did not present evidence that his securities customers had been deceived. The trial judge granted the motion and the federal prosecutors appealed to the federal 2nd Circuit Court of Appeals. On July 18, 2008 the appeals court affirmed the judge's reversal of the jury's verdict."
