Summary of Case: |
"Eamonn Flanagan and his younger brother Seamus Flanagan were wrongly convicted in November 2011 of raping a woman in a Dublin, Ireland hotel room on March 3, 2008. Their convictions were basedon the testimony of a man that he saw the two men at the door of the woman's hotel room the night of the rape. The witness claimed that he had consensual sex with the woman that night -- and his DNA was recovered from her -- while no DNA matching the brothers was found. After their convictions by a jury the brothers were each sentenced to 3 years in prison. After the men were imprisoned the witness -- Daniel Lynch -- executed an Affidavit that he had been pressured by the police (gardaí) into saying he had seen the two brothers at the door of the hotel where the alleged rape occurred. He said that he had been threatened with seven years in prison for "covering up" for the Flanagans if he didn't provide the evidence the police wanted. The men appealed based on the new evidence. On October 1, 2014 Ireland's Court of Appeal quashed the Flanagan brother's convictions ruling and approved dismissal of the charges on the basis that the new evidence would have rendered it extremely difficult for any prosecution in a retrial." |
