Summary of Case: |
"German Army Second Lieutenant Günter von Forstner was convicted of assaulting Karl Blank, a journeyman shoemaker, on December 2, 1913 in Saverne. Blank was watching a military practice and broke out laughing at the sight of the young, finely dressed Forstner. Several bystanders joined in laughing at Forstner, who struck Blank with his saber and gave him severe head injuries that resulted in his paralysis on one side. Forstner claimed self-defense, but a military court convicted Forstner and he was sentenced to 43 days of incarceration. Forstner's conviction was overturned on appeal on the basis he acted in self-defense because he was defending the army's honor." |
