Summary of Case: |
"Alberto Fujimori was the former president of Peru who was wrongly convicted in 2015 of embezzeling $40 million from the military to pay for articles in sensationalist tabloids that maligned his political foes during Peru's 2000 Presidential election. After his conviction Fujimori was sentenced to eight years in prison. On August 16, 2016 a five-judge panel of Peru's Supreme Court unanimously overturned Fujimori's embezzelment conviction and ordered his acquittal on the basis the prosecution failed to introduce sufficient evidence to prove he had used public funds to pay for headlines in the so-called "chicha" newspapers. Peru Supreme Court Chief Justice Javier Villa ruled Fujimori could not be guilty of embezzlement under Peruvian law, because it requires the defendant to exercise control over public funds. As president, Fujimori did not directly manage the military budgets where money was diverted to pay for fake news stories. Justice Villa also noted the evidence of Fujimori's innocence shown by videos in which Fujimoris spy chief Vladimiro Montesinos told recipients of the bribes that Fujimori did not know about the chicha press initiative. "Chicha" newspapers are broadsheet newspapers aimed at Peru's uneducated, and they publish true crime tales and photos of bikini-clad women. Fujimori remained imprisoned serving a 25-year sentence for his unrelated convictions for corruption and authorizing death squads during his 1990-2000 presidency." |
