Summary of Case:

"Milton Gale and Dontrell Baker were codefendants wrongly convicted on June 13, 1997 of three couns of armed robbery related to the robbery of a Holiday Inn motel on July 26, 1996 in St. Petersburg, Florida. A third defendant, David Shavers, was acquitted by the jury. Gale was convicted based on the prosecution's theory that Shavers and Baker actually committed the robbery, but that Gale was the mastermind who planned the operation and disposed of incriminating evidence afterward. At the close of the prosecution's case the judge denied Gale's motion for a directed verdict due to the prosecution's failure to present sufficient evidence proving his guilt beyond a reasonable doubt. Gale appealed his conviction. On January 15, 1999 the Florida Court of Appeals, Second District, reversed Gale's armed robbery convictions in a ruling that stated: "Gale presented a reasonable hypothesis of innocence [at trial] that was consistent with the State's evidence. He explained how his fingerprints and his truck came to be at the motel, and how he knew of the robbery shortly after it occurred. He also gave an innocent reason for taking the guns from the dumpster. ... Because the State's evidence was not inconsistent with Gale's theory of the events, the State failed to meet its burden. Accordingly, the trial court should have granted Gale's motion for judgment of acquittal. Reversed and remanded with directions to discharge Gale." Gale v. State,726 So. 2d 328 (Fla: Dist.
