"Dr. Pramela Ganji and Elaine Davis were codefendants wrongly convicted in federal court in Louisiana of conspiracy to commit health care fraud by defrauding Medicare out of more than $14 million. Ganji and Davis were jointly tried. After her conviction by a jury Ganji was sentenced to six years in federal prison to be followed by two years of supervised release, and payment to Medicare of $5,048,518 in restitution. Davis was sentenced to 8 years in federal prison to be followed by two years of supervised release, and payment to Medicare of $9,305,647.26 in restitution. Ganji and Davis appealed. On January 30, 2018 the Fifth U.S. Circuit Court of Appeals reversed and vacated the convictions of Ganji and Davis on the basis the prosecution failed to introduce sufficient evidence to prove they were guilty of executing a scheme to defraud Medicare." |
