Summary of Case:	"Samantha Garcia was wrongly convicted of child abuse by endangerment in Curry County, New Mexico. The jury convicted Garcia based on the prosecution's contention that a neighbor's discovery of her three-year-old son wandering around outside at 2 am wearing only a diaper while Garcia was asleep in their apartment constituted child abuse by endangerment. Garcia had been drinking alcohol and smoking marijuana before falling asleep. Garcia made a motion for a directed verdict at the close of the prosecution's case, arguing there was insufficient evidence to support her guilt. The motion was denied and Garcia presented no evidence in her defense. Garcia was sentenced to three years in prison which the judge suspended on condition of three years good behavior on probation. On October 7, 2013 the New Mexico Court of Appeals reversed Garcia's conviction on the basis there was insufficient evidence to support her conviction."
