Summary of Case:

"Nicholas Garret and Eric Groething were wrongly convicted of misdemeanor simple assault and petty harassment. Groething argued he acted in self-defense against Nicholas Garret during a physical altercation in the basement laundry room of a Jersey City, New Jersey apartment building. The incident was filmed by a security camera. Groething was a Plainfield police officer. Both men were convicted following a bench trial, Groething and Garret were both sentenced to the minimum of $125 in fines -- $50 for Victims of Crime and $75 for Safe Neighborhood. Both men appealed. On appeal the Law Division judge acquitted Garrett of all charges. The Law Division judge acquitted Groething of harassment, about which he ruled there was "no evidence" to support that conviction. However, he ruled that Groething was actually guilty of misdemeanor assault, and increased his penalty by requiring him to have anger management and/or cultural sensitivity training. Groething appealed. On August 7, 2017 the Appellate Division of the Superior Court of New Jersey acquitted Groething, ruling double jeopardy barred his conviction of misdemeanor assault."
