Summary of Case: |
"Marwa Joel Gasebo was wrongly convicted of manslaghter and sentenced to life in prison for a death in Rong'abure, in Tanzania's Serengeti district on May 3, 1998. Gasebo's conviction was based on the dying declaration of the victim, supported by two other witnesses. In June 2014 Tanzania's Court of Appeals vacated Gasebo's conviction on the basis the High Court judge had not properly addressed the legal importance of the alleged dying declaration. The Court stated, "We hasten to hold that such non-direction to assessors constituted procedural lapse which undermined the conduct of the entire trial. Accordingly, in the exercise of our revisional jurisdiction under the Appellant Jurisdiction Act, we nullify the proceedings and the judgment of the High Court."" |
