Summary of Case:

"J. W. Gayfield was wrongly convicted on January 11, 2012 in Urbana, Illinois of aggravated unlawful use of a weapon, based on a prior felony conviction. Gayfield was sentenced to seven years in prison. He appealed. On August 19, 2013 the Illinois Court of Appeals affirmed Gayfield's conviction and sentence. Gayfield filed a petiton for rehearing on the basis his conviction should be reversed because the AUUW statute he had been convicted of violating was unconstitutional. Gayfield's petition was denied. On October 9, 2013 Gayfield fieled a motion with the Illinois Supreme Court, which it granted on November 6, 2013, ordering the appeals court to vacate its denial of his petition for rehearing. On July 8, 2014 the Illinois Court of Appeals vacated Akins' aggravated unlawful use of a weapon conviction on the basis the Illinois' statute criminalizing that conduct had been declared unconstitutional by the Illinois Supreme Court in People v. Aguilar, 2 NE 3d 321, 2013 IL 112116, 377 Ill. Dec. 405 (Ill. Supreme Court, 9-12-2013 )."
