"Albert Gerhart was wrongly convicted in 2014 of blackmail and computer crimes allegedly committed in 2013. Gerhart, an Oklahoma City carpenter, was co-founder of the Sooner Tea Party. After his conviction by a jury, the jury recommended a fine of $1,000 for the blackmail count, and no punishment for the computer crimes count. The judge went along with the jury's recommendation and sentenced Gerhart to pay a fine of $1,000. On October 7, 2015 the Oklahoma Court of Criminal Appeals by a 3 to 2 vote reversed Al Gerhart's conviction on the ground his conduct was protected as free speech, and ordered that the trial court dismiss his charges."
