"Matthew James Gibbs was wrongly convicted on June 21, 2017 of selling or supplying a prohibited drug -- cannabis -- to another person in Sinagra, Western Australia, Australia on January 13, 2016. Sinagra is a suburb north of Perth. The prosecution's case was based on circumstantial evidence and inferences. Matthew Gibbs appealed after his conviction by a jury. On May 11, 2018 the Western Australia Court of Appeals unanimously quashed Gibbs' convictions on the basis the prosecution introduced insufficient evidence to prove his guilt beyond a reasonable doubt. Justice Buss stated in his opinion: "The verdict of guilty was unreasonable. It was not supported by evidence that the jury was entitled to accept and inferences that the jury was entitled to draw. On the basis of the manner in which the State ran its case at the trial, I have a reasonable doubt as to the appellant's guilt and as to the correctness of his conviction."" |
