Summary of Case:	"James Curtis Giles was wrongly convicted in June 1983 of participating in a gang rape on August 1, 1982 in the home of the victim and her husband in Dallas, Texas. Giles' conviction was based on the victim's identification of Giles from a photo array. However, James Giles had been mistakenly included in the photo array by the police's confusing him with a suspect who had the first and last name. Information about that suspect was provided by a co-defendant. Giles was released on parole in 1993 after 10 years of imprisonment. DNA tests unavailable at the time of Giles trial excluded him as one of the perpetrators. Giles conviction was vacated in April 2007. On June 20, 2007 the Texas Court of Criminal Appeals granted Giles writ of habeas corpus, ruling that, "no rational jury" would have convicted Giles in light of the new evidence, which "indicates that it was another individual ... who committed the offense." James Giles had spent 10 years in prison and 14 years as a registered sex offender."
