Summary of Case:

"Kaleb Kihongo Fanuel and James Marwa Giriri were wrongly convicted on July 1, 2014 of criminal contempt in a lawsuit about the title to property in the Koboro Village in Tanzania. The trial judge summarily found Fanuel and Giriri were in contempt of a court order and each was sentenced to a month in jail. Fanuel and Giriri appealed. In October 2014 Tanzania's Court of Appeals quashed the contempt convictions of Kaleb Fanuel and James Giriri in ruling, "We need not go far away from the record of the trial court on July 1, 2014, to find that indeed the two applicants were denied of their basic right to be heard on allegation that they were in contempt of the trial court's orders." The appeals court observed that proceedings of the trial court showed that basic procedural due processes were not extended to the two officials."
