Summary of Case: |
"A south east Asian girl was wrongly convicted of being involved in drug production in Teesside, England. The girl pled guilty. After her conviction it was discovered that the girl was 16 when she was forced into the sex industry in England by a family friend after her grandmother, who was taking care of her, died. After her grandmother died the man tricked her into going to England where he said her mother was living. After arriving she was hit, and threatened into having sex with men for money. When she escaped she encountered a man at a train station who offered her a place to stay. It turned out that he was a marijuana producer and he forced her to help. After her conviction the girl was sentenced to prison. It was discovered after her incarceration that she had been the victim of human trafficking and forced into participating in the drug production, and that at the time of her arrest she was still a minor. A petition was filed to set-aside her conviction based on the new evidence. The Crown Prosecution Service did not oppose her petition, stating that it would not have pursued her prosecution if it had known the circumstances and facts of her case, and that she was a minor. In October 2016 the Criminal Court of Appeals for England and Wales quashed the girl's conviction on the basis that there was compelling evidence she was the victim in the case. The Court stated: "It is accepted by the crown that she was trafficked, initially for sexual exploitation, and thereafter, having escaped, for servitude in cannabis cultivation. We are satisfied that the conviction is not safe." |
