Summary of Case:	"Gopal aka Gopi Ramdev Shetye was wrongly convicted in 2010 of raping a woman in Ghatkopar, Maharashtra, India on July 19, 2009. Shetye was arrested 10 days later, on July 29. The victim and Shetye did not know each other, and she was shown Shetye by the police prior to her viewing a line-up, from which she picked him as her attacker. Shetye was denied bail, and he denied raping the woman. During his trial in 2010 the prosecution presented no physical evidence linking Shetye to the crime, so its case was based solely on the victim's identification of him. However, her identification was not recorded in the trial record by her statement, but by way of a note by the trial judge that: "Witness identifies accused present before the court.” During Shetye's trial the prosecution attempted to withhold the evidence that the victim was shown Shetye by the police before she identitfied him in a line-up. Shetye was sentenced to 7 years in prison. Shetye filed his appeal on July 14, 2010. Shetye was released from prison in 2014 after serving about five years. On June 10, 2015 the Bombay High Court quashed Shetye's conviction based on the unreliability of the victim's identification, and ordered his acquittal because without her testimony there was insufficient evidence to support his conviction."
