Summary of Case:

"Anthony Graves was wrongly convicted in 1994 of being a participant in the 1992 murder of six members of the same family. The only evidence against Anthony Graves was the testimony of his codefendant Robert Earl Carter, who recanted before his 1998 execution. Graves was sentenced to death. In 2006 the federal 5th Circuit Court of Appeals overturned Graves' conviction, ruling that prosecutors withheld evidence and elicited false testimony from Carter. The prosecutors decided to retry Graves, and for four years he was in the Burleson County Jail awaiting his retrial. On October 27, 2010, the charges were dismissed against Graves and he was released after 18 years of incarceration, 12 on death row. On June 22, 2011 Texas Governor Rick Perry signed special legislation awarding Graves $1.45 million in compensation. Graves had been denied compensation under Texas' wrongful conviction compensation statute because the judge's order dismissing his indictment doesn't state he is 'actually innocent.' Graves received the $1.45 million check from the Texas Comptroller's Office on June 30, 2011."
