Summary of Case: |
"Michael Anthony Green was wrongly convicted in 1983 of aggravated sexual assault in Houston, Texas based on the victim's identification of him in a photo array and a lineup. When she first saw the the 18-year-old Michael Green in the back of a police car she said he was not involved. The victim said four men were involved, but Green was the only person arrested and prosecuted. Green was sentenced to 75 years in prison. In 2010 DNA testing of biological evidence Green was excluded. The DNA testing was unavailable at the time of Green's 1983 trial. The DNA profile of the four perpetrators was identified, and three of them admitted involvement with questioned by Harris County DA investigators. However, the statute of limitations has expired so they could not be charged with the crime. On July 30, 2010 Green was released on $500 bond after 27 years of wrongful imprisonment. The Texas Court of Criminal Appeals ruled on October 20, 2010, that Green was actually innocent, which made him eligible for compensation under Texas' wrongful conviction compensation statute. On November 22, 2010, the Harris County DA's Office filed a motion to dismiss the charges against Green that was granted." |
