Summary of Case:

"Mangal Bahadur Gurung was a Nepalese migrant worker wrongly convicted of being an illegal immigrant in Malaysia and sentenced to 10 months imprisonment. When he pled guilty he hadn't been provided with an interpreter so he didn't know what he was agreeing to plead guilty to committing. The Malaysian High Court reversed his conviction after he had been imprisoned for 2-1/2 months. When convicted, the judge ignored that he had photocopies of his passport and work permit that proved he was a legal worker. His employer had taken and was in possession of the originals. Although Malaysia has no scheme to compensate the wrongly convicted, Gurung filed a claim with the government. In February 2006 the Malaysian offered financial compensation of RM8,340 (U.S. equivalent of $2,246). It was the first time Malaysia offered compensation to a wrongly convicted person."
