Summary of Case:

"Adam Adli Abdul Halim was wrongly convicted on November 19, 2014 of seditious speech at a public rally in Kuala Lumpur, Malaysia on May 13, 2013. After his conviction following a bench trial in the Sessions Court Adam Adli was sentenced to 12 months in prison. Adli appealed. In 2016 the High Court affirmed his conviction but substitued a fine of RMS5,000 or two years in prison if not paid. Adli appealed. On February 22, 2018 the Malaysia Court of Appeal unanimously set-aside Adli's conviction. In the ruling announced by Justice Mohd Zawawi, the Court ruled there were many untenable misdirections of law by the Sessions Court judge, which rendered Adli's conviction unsafe. Zawawi stated that among the serious misdirections of law was that Adam Adli was ordered to enter defence under Section 3 (1) (a) of the Sedition Act 1948 for allegedly bringing into hatred against any ruler or against the government. However, Zawawi observed that Adli was found guilty of a different offense that he was charged with: insulting the judiciary or the subjects of the king or promote ill feelings among the multi racial society in Malaysia which had no connection to his speech at the rally."
