Summary of Case: |
"Lacey Phillips and her boyfriend Erin Hall were codefendants wrongly convicted in September 2011 of conspriacy to defraud Fremont Investment & Loan by falsifying their application for a $220,000 home loan in June 2006. Phillips and her boyfriend were both sentenced to serve 60 days in federal custody and make total restitution of almost $88,000. In September 2013, the U.S. 7th Circuit Court of Appeals reversed their convictions on the basis the trial judge erred by not allowing Phillips and Halls to introduce their evidence supporting their defense they had no criminal intent to make a false statement to induce the bank to make the loan. The Eastern District of Wisconsin's U.S. Attorneys Office moved to dismiss the charges, which was granted by the District Court judge on January 29, 2014." |
