Summary of Case:	"Lister W. Harrell was wrongly convicted in June 2014 of criminal intimidation of two court officers in April 2013 and cruelty to animals. Harrell's intimidation conviction was based on a threat to post on the Internet a sex tape of a female deputy court clerk having sex with Harrell and two other men. His animal cruelty conviction was based on an unrelated incident of allegedly placing a dead cat in the mailbox of his former girlfriend in April 2013. Harrell was sentenced to six years in prison to be followed by six years of probation. Harrell was taken into custody in June 2014. On October 5, 2015 the Georgia Supreme Court unanimously reversed Harrell's intimiation conviction on the basis insufficient evidence was introduced of his guilt because he didn't threaten an “unlawful act of violence” as required by the statute, and his verbal threats unconnected to any action were protected free speech. The Court overturned his animal cruelty conviction because the trial judge erred in denying Harrell's pretrial motion for a separate trial from his intimidation charge because there was no connection between the two."
