Summary of Case:

"Kurt William Havelock was wrongly convicted of mailing a threatening communication about a letter he mailed 30 minutes before the start of the Super Bowl in 2008 in Phoenix that he intended to shoot people attending the event and commit suicide by cop. Hevelock was convicted by a jury and sentenced to 366 days in prison. On January 6, 2012 the U.S. Ninth Circuit Court of Appeals En Banc overturned Havelock's conviction on the basis his letter didn't constitute a violation of the statute (18 U.S.C. § 876(c)). The Court stated: "Havelock's choice to use snail mail, particularly on a Sunday, thirty minutes before the Super Bowl where he intended to shoot attendees and commit "suicide by cop," guaranteed that by the time anyone actually received the communication, the deed would be done—not merely threatened." US v. Havelock, 664 F. 3d 1284, 1314 (9th Cir 2012) (En Banc)"
