Summary of Case:

"Reginald D. Hayes was wrongly convicted on December 13, 1985 of murder with a deadly weapon and four counts of attempted murder with a deadly weapon related to an incident in Las Vegas, Nevada on the night of August 9-10, 1985. Hayes was 14 at the time of the crimes, but he was tried as an adult. On January 17, 1986 Hayes was sentenced to two terms of life in prison without the possibility of parole, plus 80 years in prison (four consecutive terms of 40 years in prison for the attempted murder convictions, with 80 years suspended and 5 years probation substituted), and 5 years probation. Hayes convictions were affirmed on appeal. On July 21, 1992 Hayes' petition for post-conviction relief was denied, and the Nevada Supreme Court remanded for an evidentiary hearing. After extensive post-conviction proceedings, on October 1, 1998, Hayes entered into a settlement agreement with the State (Guilty Plea Agreement) in which his murder and attempted murder convictions would be vacated and his indictment was amended to include a charge of first degree kidnaping, in exchange for his no contest plea to committing kidnapping and his agreement to be sentenced to a term of life in prison with immediate eligibility for parole. Hayes had not been originally charged or convicted of kidnapping. On November 19, 1998 Clark County Judge Kathy Hardcastle approved the agreement, but deviated by sentencing Hayes to the time he had served, 13 years, 3 months and 11 days, and he was released immediately. On December 7, 1999 Hayes civil rights to vote, serve on a jury, and own and possess a firearm were restored by the unconditional pardon granted by the Nevada Board of Pardons. The pardon did not affect Hayes' kidnapping conviction, that he unsuccessfully attempted to have judicially overturned after his pardon was granted."
