Summary of Case:

"Carl Hobbs, aka Carl Douglas Hobbs, was wrongly convicted on July 27, 2004 of grand larceny in the theft of money from John Streeter on August 25, 2003 in Greenville, Mississippi. Hobbs cashed checks at his bank totaling over $3,338.04 and put the money in an envelope. When he got in his van Streeter put the envelope by his parking brake and placed his Bible on top of it to conceal it. Streeter saw his acquaintance Hobbs, and gave him a ride. Streeter did not tell Hobbs he had cash in the van. They stopped at a lumber yard where both Streeter and Hobbs got out, with the doors unlocked and the windows down with people around. When Streeter arrived home he went inside with his unlocked van with the windows down. He later remembered he left the cash in his van, but when he went out to get the envelope he found it was missing. Streeter reported to the theft to the police, and told them he had given Hobbs a ride in his van after cashing the checks. The police investigated and found that Hobbs had recently bought a keyboard for $548 in cash. Hobbs told them he was a muscian and he bought the keyboard with money saved from the $175 in cash he was paid every Sunday for performing at three different churches, and he also gave music lessons for cash. He also told the police he stashed his cash in two different places. Although Hobbs gave police the names of the churches he performed at, the names of his musical students, and the locations where he stashed his music cash, the police made no effort to verify Hobbs' information. The Bible that had to be moved to get at the envelope with Streeter's cash was checked and it didn't have Hobbs' fingerprints on it. Hobbs was charged with grand larceny, and prosecuted based on the facts he had been given a ride by Streeter and he had bought a keyboard for cash. After his conviction by a jury Hobbs was sentenced to 10 years in prison with 7 suspended, conditioned upon successfully completing seven years of supervised probation after his release. Hobbs appealed, arguing that no evidence had been presented he stole the money and it was only possible he did so, because he, along with an unknown number of other people, could have stolen the money from the unlocked van that was parked in multiple locations with its windows down. On April 4, 2006 the Mississippi Court of Appeals reversed Hobbs' convictions on the basis of insufficient evidence. The appeals court ruling stated: "We find that the evidence failed to exclude every reasonable hypothesis consistent with innocence. Therefore, the evidence offered was insufficient to sustain a grand larceny conviction. We reverse and render Hobbs' conviction." ("
