Summary of Case:

"Jeffrey Scott Hornoff was wrongfully convicted of the 1989 murdering a woman with whom he had a brief affair based solely on the fact that he initially lied to investigators that he had been involved with her, in an effort to keep his wife from learning about the affair. After it was shown he lied to investigators about his brief involvement with the woman, no one believed his protestations of innocence. In Oct. 2000 the Rhode Island Supreme Court upheld his conviction. Hornoff was released on November 6, 2002 after 6-1-2 years imprisonment when the actual killer, Todd Barry, confessed to police because he said he couldn't live with the thought that another man was spending his life in prison for a crime that Barry had actually committed. In 2005 Jeffrey Hornoff filed separate federal civil rights lawsuit against the City of Warwick and the Rhode Island State Police that handled the investigation. Settled suit against the City of Warwick on August 15, 2006 for $600,000 plus a work-related disability pension from his job as a Warwick policeman that he was fired from when he was convicted that guaranteed him $47,000 a year, tax free, with payments retroactive to July 18, 2006. At that time the RI State Patrol declined to settle the lawsuit filed against them. In March 2007 Hornoff dropped his lawsuit against the state police and his lawyer told reporters that Hornoff, his wife and daughter were moving out of state."

"Prosecution's false theory of the crime that Hornoff could have been at a party where many people saw him, and at the same time in another part of town where the woman he knew was bludgeoned to death in her apartment."
