Summary of Case:

"Darryl Howard was wrongly convicted in 1995 of the strangulation and sexual assault of 29-year-old Doris Washington and her 13-year-old daughter, Nishonda. After his conviction by a jury Howard was sentenced to 80 years in prison for the double murder. Post-conviction DNA testing excluded Howard as the source of crime scene evidence, and no physical evidence connected him to the crime. Based on the new evidence Howard filed a petition for a new trial. On August 31, 2016 a judge granted Howard's petition and granted a new trial after the Durham County District Attorney's Office announced at the start of the hearing on the 31st that it was withdrawing its opposition to the petition, and Howard was released later that day. The Durham County DA's Office filed a motion to dismiss the charges, which was granted on September 2, 2016. Howard was prosecuted by then-Durham County DA Mike Nifong, who resigned over his handling of the Duke Lacrose false rape case in which he prosecuted innocent Duke players for a rape that never happened."
