Summary of Case: |
"Timothy Howard was co-defendant of Gary Lemar James. Both men wrongly convicted in 1977 of a December 31, 1976 bank robbery and murder based on the prosecution's concealment of exonerating evidence. Both men were sentenced to death, but were resentenced to life in prison when Ohio's death penalty was declared unconstitutional in 1978. "The case against Howard and James unraveled when new evidence was uncovered, some through Freedom of Information Act requests filed by Howard. Fingerprints and conflicting witness statements made to the FBI were not made available to defense attorneys." (Cincinnati Enquirer, July 17, 2003) Timothy Howard was released on April 23, 2003 after his conviction was reversed because of concealed exonerating evidence. Howard was found 'actually innocent' in March 2006 after a trial held to determine his eligibility for compensation under Ohio's wrongful conviction compensation statute. Timothy Howard was subsequently awarded compensation of $2.5 million on June 28, 2006 by the state of Ohio. The settlement was broken into a lump sum payment of $1,438,242.67, and a periodic annuity funded by $1,061,757.33. Howard died in March 2007 of a heart attack." |
