Summary of Case:

"Sheldon Isitt was wrongly convicted on February 2, 2016 of seriously assaulting a 61-year-old woman in North Lakes, Queensland, Australia. Isitt's prosecution was based on his prank gone wrong in 2014 of making a YouTube video of tying a plastic snake to fishing line and placing it in a walking path at Lake Eden in North Lakes, a suburb of Brisbane. A woman walking on the path got her legs tangled up in the fishing line, but she did not trip or fall. She saw the rubber snake as she was ripping off the fishing line. Isitt was smiling when he walked towards the woman, and she said: "You think this is funny?” and he said: “Yes, I do." Isitt was charged with assaulting the woman, even though she was not harmed and he did not apply any force to her. After his bench trial, he was convicted by a Pine Rivers Magistrates Court judge of serious assault. The judge said that Isitt indirectly applied force to the woman by placing the fishing line in the path. Isitt was sentenced to pay a AUS$300 six-month good-behaviour bond. If he failed to comply with the conditions he could be jailed for the six months. Isitt appealed. On November 25, 2016 Brisbane District Court Judge Paul Smith allowed Mr Isitt’s appeal, and found him not guilty based on insufficient evidence and quashed his conviction."
