"Max Jackson and Charles Fraser were codefendants wrongly convicted on June 20, 1904 of larceny in Boston, Massachusetts. Fraser and Jackson, both 18, were prosecuted along with a third defendant for allegedly stealing foreign postage stamps worth $7. After their convictions in the Boston Municipal Court they were given indeterminate sentences in the Massachusetts reformatory. All three appealed to the Superior Court. After Fraser and Jackson withdrew their appeals the conviction of their codefendant was nol prossed in the Superior Court based on insufficient evidence and he was released from custody. On November 23, 1904 Fraser and Jackson were pardoned by Massachusetts Governor William Lewis Douglas with the District Attorney's recommendation, based on their cases would also have been nol prossed if they had not withdrawn their appeal." |
