Summary of Case:

"Gary Lamar James was codefendant of Timothy Howard. Both men were wrongly convicted in 1977 of a December 31, 1976 bank robbery and murder based on the prosecution's concealment of exonerating evidence. Both men were sentenced to death, but were resentenced to life in prison when Ohio's death penalty was declared unconstitutional in 1978. "The case against Howard and James unraveled when new evidence was uncovered, some through Freedom of Information Act requests filed by Howard. Fingerprints and conflicting witness statements made to the FBI were not made available to defense attorneys." (Cincinnati Enquirer, July 17, 2003) Timothy Howard was released on April 23, 2003 after his conviction was reversed because of concealed exonerating evidence. Gary James was awarded $1,500,000 in compensation by the State of Ohio on May 17, 2007. James was to receive $1,000,000 immediately, and $500,000 disbursed over 15 years -- until 2022, in monthly payments of $2,526.01. His lawyers were to receive the remaining $300,000."
