Summary of Case:	"Alvin Jardine III was wrongly convicted in 1992 after two trials ended in a hung jury, of four counts of first-degree sexual assault, three counts of attempted first-degree sexual assault, first-degree burglary, and kidnapping a woman in Maui in 1990. The only evidence against Jardine was the woman's identification he was her assailant. Jardine was sentenced to 35 years in prison. In 2010 DNA tests of a tablecloth that had been covering a papa-san chair that the rapist sat on during and after the assault excluded Jardine. His lawyers filed a motion for a new trial based on the new evidence. On January 21, 2011 Jardine's conviction was overturned and he was released later that day on $75,000 bail. His retrial was scheduled for June 27, 2011, but with the pasage of time it was believed the prosecution would move to dismiss the charges. Jardine was assisted by the Hawaii Innocence Project."
