Summary of Case:

"Wrongly convicted in November 2004 of feloniously sending up to 10 million spam emails per day. Jeremy Jaynes was sentenced to nine years imprisonment. Because Jaynes was the first person convicted of Virginia's felony anti-spam law, the judge stayed execution of his sentence pending his legal challenges to the statutes legality. In September 2006 the Virginia Court of Appeals upheld his conviction, as did the Virginia Supreme Court in September 2007. Upon a rehearing on the issue of if the statute's constitutionality, on September 12, 2008 the Virgina Supreme Court ruled the law was overly broad and a violation of the right to free speech. Consequently Jaynes' conviction was vacated. "
