"Robert Thomas Johnson III was wrongly convicted in 2015 of possession of amphetamine in Galveston County, Texas. Robert Johnson pled guilty and was sentenced to two years in prison. After Johnson's conviction the substance was tested by the crime lab and found to be amphetamine in an FDA-approved form. Johnson filed a writ of habeas corpus based on the new evidence seeking to withdraw his guilty plea on the basis it was not a knowing and intelligent decision. His writ was unopposed by the State, and the habeas judge recommended his writ be granted. On April 12, 2017 the Texas Court of Criminal Appeals granted Johnson's writ." |
