Summary of Case:

"Tom Jones was wrongly convicted in 1936 of murdering his wife in Kentucky and sentenced to death. Jones was granted stay of execution with only 5 hours to spare. After Jones' conviction was affirmed on direct appeal the Kentucky state court's denied his habeas corpus. Jones filed a federal habeas corpus petition alleging that his right to due process was denied because his conviction was based on perjured testimony. The Attorney General of Kentucky took the position that after "giving the matter more than ordinary consideration," he is "strongly inclined to the view that Tom Jones was convicted on perjured testimony." The U.S. District Court judge issued a certificate of probable cause for consideration of Jones' writ by the Court of Appeals. On June 8, 1938 the U.S. 6th Circuit Court of Appeals granted Jones' writ of habeas corpus. The charges were dismissed."
