Summary of Case:

"Matthew Sidney Judd was wrongly convicted in July 2014 of possession of methamphetamine and possession of drug paraphernalia in Emporia, Kansas in late 2013. When police executed a search warrant on a mobile home, The occupant said that Judd and his girlfriend used one of the bedrooms, although neither was present during the search. In the bedroom that Judd allegedly used the police found and seized a grinder found in a closet. A glass pipe in a zippered case was found under a couch in the living room. Testing by the Kansas Bureau of Investigation determined there were traces of marijuana in the grinder and traces of methamphetamine in the glass pipe. Judd's fingerprints were not found on the grinder or the glass pipe. During Judd's trial the prosecution's case was based on the fact that his name was on the lease for the mobile home, because no evidence was presented linking Judd to possessing either the grinder or the glass pipe, and neither Judd, his girlfriend, or other occupants of the mobile home made any incriminating statements regarding him possessing the grinder and the glass pipe. After Judd was convicted by a jury he was sentenced to 30 months in prison for methamphetamine possession to be served concurrently with lesser sentences for possession of marijuana and drug paraphernalia. Judd appealed. On May 20, 2016 the Kansas Court of Appeals reversed Judd's convictions and ordered his acquittal of possession of methamphetamine and possession of drug paraphernalia for lack of evidence showing he possessed the illicit items. Judd was released from prison a week later, on May 27, 2016."
