Summary of Case:

"In March 2015 a 16-year-old boy in Limerick, Ireland was convicted in absentia of illegally obtaining cable television broadcasts without a license. The boy was charged after a TV licence inspector discovered the illegal.reception on August 20, 2014, and took the youth's name because he was the only person at home. After the juvenile's conviction he was sentenced to serve five days or €150 fine & €70 costs. After the fine was not paid a warrant for his arrest was issued, and a member of the gardai went to his home to execute the warrant. It was at that time the juvenile's mother learned of his conviction. When she sought leave to appeal her son's conviction, she learned that his prosecution was illegal under the Children's Act, so she filed an application to set-aside his conviction. On October 8, 2015 the 16-year-old's conviction was set-aside without opposition by the prosecution, based on the illegal prosecution of the juvenile without complying with the requirements of the Children's Act that requires that any prosecution of a juvenile can only be initiated once the matter has first been referred to a specially trained Garda Juvenile Liaison Officer. The youth's name couldn't be disclosed because of his age."
