Summary of Case: |
"Adam Kalungi was wrongly convicted on February 7, 2014 of manslaughter for negligently causing the death of his girlfriend Nebanda in December 2012 in Kampala, Uganda. Kalungi was convicted after a bench trial based on the judges determination that he was criminally responsible for not taking her to a hospital until 7 p.m. when she first began getting sick at 4 a.m. On July 4, 2014 Uganda's High Court acquitted Kalungi on the basis of insufficient evidence he committed a crime, because he promptly administered first aid upon finding his girlfriend was ill and when she worsened he had her attended to by a man who claimed to be a medical officer, and when her condition didn't improve he took her at his own expense to the Mukwaya General Hospital where she died. The Court opined that if anyone should have been charged it was Emmanuel Kizza Lwakataka, the man who claimed to Kalungi that he was a medical officer." |
