Summary of Case:

"Joe Kalusa was wrongly convicted in March 2013 in Ndola, Zambia of threatening violence against Forum for Democracy and Development President Edith Nawakwi in September 2012. Kalusa was fined K10 million (US$1,819,900). Kalusa conviction was based on a newspaper story published in Zambia's Post newspaper. The newspaper article's author testified that Kalusa said that "“Maybe he can organise UPND cadres to gun rape Nawakwi for insulting UPND leader.” In late May 2013 Kalusa's conviction was quashed on appeal, on the basis the evidence introduced at trial was insufficient evidence to prove he committed the offense of making a threat, since his comment was qualified by him saying "maybe.""
