Summary of Case:

"Mr. Karn was wrongly convicted in 1945 of larceny in the theft of $1,217 from the Chena Bar in Fairbanks, Alaska on September 15, 1945. At the time the Territory of Alaska was not a state. The prosecution's case was wholly circumstantial, with no physical, forensic, eyewitness or confession evidence directly linking him to the crime. The District Court judge denied Karn's motion for a directed verdict of acquittal at the close of evidence, with Karn offering no evidence or testimony in his defense. The jury convicted Karn and he was sentenced. Karn appealed. On December 2, 1946 the U.S. Ninth Circuit Court of Appeals on the basis the prosecution offered no credible evidence linking Karn to the crime. The Court's ruling stated: "The judgment of the district court is reversed and the cause remanded to the district court with directions to vacate the judgment of sentence herein and to enter a judgment of acquittal of the appellant.""
