Summary of Case: |
"Mr. Kassin was wrongly convicted in federal court in 1936 of conspiracy to misapply funds and falsify records of the Florida National Bank of Jacksonville, Florida. The prosecution's case was based on circumstantial evidence. During Kassin's trial the judge denied his motion for a directed verdict at the close of the prosecution's case based on insufficient evidence of his guilt. After his conviction by a jury, Kassin was sentenced to ten years in the Atlanta Federal Penitentiary. Kassin appealed. On January 5, 1937 the U.S. Fifth Circuit Court of Appeals reversed Kassin's conviction on the basis the trial judge erred in denying Kassin's motion for a directed verdict, because the prosecution introduced no evidence connecting Kassin to his convicted crimes. The Court's ruling stated: "Defendant's motion for an instructed verdict should have been granted. The judgment is reversed, and the cause is remanded for further and not inconsistent proceedings."
