Summary of Case:

"Wrongly convicted in 1992 of fraud, racketeering, and conspiracy related to the failure of Lincoln Savings and Loan in the 1980s. Charles Keating was sentenced to 10 years in prison. Keatings convictions were upheld on direct appeal, and California state courts declined to grant his habeas corpus petition. Keating then filed a writ of habeas corpus that was dismissed by the U.S. District Court, but on appeal the 9th U.S. Circuit Court of Appeals granted the petition, ruling that the trial judge (Lance Ito of O.J. Simpson fame) mistakenly failed to instruct the jury that they had to determine he intended to defraud investors before convicting him. Keating was released on bond after 4-1/2 years imprisonment. In October 2000 the prosecutors dismissed the charges."
