Summary of Case:

"James Edward Kelton was wrongly convicted in 2013 Tumbarumba, New South Wales, Australia of having a horse trapping device on government property he leased from the government and taking four wild horses ("brumbies") in a state forest in June 2012. During his two day trial in the Tumbarumba Local Court Kelton, 63, didn't deny he had the trap and took the horses ("brumbies"). He claimed in his defense that a forestry employee had given him permission after an audit to trap brumbies, and that he acted in accordance with the conditions of his lease and complying with the Foresty Act by removing feral animals. Kelton was convicted and fined AUS$1,000. Kelton appealed, and in January 2014 the District Court in Sydney quashed his convictions. After his convictions were quashed Kelton told reporters he was considering civil action against the police and the Forestry Corporation. He said he has intended to manage his leases effectively to protect a range of threatened species, ecological communities and populations known to occur within them."
