Summary of Case:

"Evin King was wrongly convicted in 1995 of the murder of his girlfriend, Crystal Hudson, on June 21, 1994 in Cuyahoga County, Ohio. She had been strangled and beaten to death. King was convicted based on the circumstantial evidence and expert DNA testimony: he spent the night of the 21st at her home with her decaying and odorous body stuffed in her closet (her body was discovered on the morning of June 22, 1994); and, there were no signs of forced entry; and, although the DNA test of semen found in her didn't match King, then-Cuyahoga County Coroner pathologist Dr. Robert Challener testified at King's trial that, based on the number and quality of the sperm, it was reasonable to believe the fluid was from a sexual encounter "two or three days prior to her death" -- and thus not from her murderer. After his conviction King was sentenced to life in prison. Advances in DNA technology enabled crime scene evidence that couldn't be tested in 1995, to be tested in 2009. That included skin cells scraped from underneath Hudson's fingernails. That post-conviction testing discovered the DNA of the skin cells matched the DNA of the semen. In 2015 King filed a post-conviction petition for a new trial based on the exculpatory DNA evidence, and he requested that the DNA profile from the semen and skin cells be uploaded to the FBI's CODIS national DNA database to see if the person could be identified. The trial judge denied King's motion without a hearing. However, on January 19, 2017 the Ohio 8th District Court of Appeals reversed the judge's ruling, and ordered that the uploading of the DNA profile to the CODIS database; ordered that King be given access to the evidence for further testing; and ordered an evidentiary hearing. In January 2017 Michael O'Malley assumed his duties as the Cuyahoga County Prosecutor's Office. He ordered a review of King's case. It was discovered that the DNA profile had been uploaded to CODIS in 2009, but no match had been made. Based on the new evidence O'Malley decided to support the vacating of King's conviction. On April 19, 2017 the motion by the Cuyahoga County District Attorney's Office to dimiss the indictment against Evin King was granted, and he was released."
