Summary of Case:

"Tyler Sherwood King was wrongly convicted on November 21, 2006 of reckless driving on Interstate 5 near Vancouver, Washington. The trial judge denied King's pretrial motion to dismiss his charge based on the police officer's lack of jurisdiction to stop and cite him. After his conviction by a jury in the municipal court, Tyler King was sentenced to serve two days of community service, two years of probation, pay a $446 fine, and take a defensive driving course. King appealed. King appealed and the Clark County Superior Court affirmed his conviction. The Washington Court of Appeales denied review of the Superior Court's order. The Washington State Supreme Court granted King's petition for review. On October 15, 2009 the Washington Supreme Court reversed King's conviction on the basis the trial judge erred denying King's motion to dismiss, because the City of Vancouver police officer lacked jurisdiction to arrest King for reckless driving on the freeway outside the Vancouver city limits, because the officer was outside his jurisdiction and there was no emergency to stop and arrest him."
