Cody Klyne's conviction was based on the eyewitness testimony of two police officers who only momentarily saw the car's driver. The Manitoba Court of Appeal overturned Klyne's conviction in August 2007 on the basis that the officer's identification was too unreliable to support Klyne's conviction.
