Summary of Case:

"Fred Korematsu was a shipyard welder from Oakland who refused to obey the US government internment order. He was arrested, convicted of a felony and interned in Utah. He reopened the case in 1983 and a federal court in San Francisco overturned the conviction, stating that the government's case at the time had been based on false, misleading, and at racially biased information. (SFEC, 3/8/98, p.W27). Defendant in famous Korematsu v. U.S. case in which the U.S. Supreme Court endorsed the Executive Order authorizing the forced internment of Japanese on the West Coast in the interests of National Security. In 2011 Solicitor General of the U.S. Neal Kayyal admitted that in 1944 then SG Charles Fay suppressed in the government's Korematsu brief that claims of sabotage by Japanese-Americans were false and official findings that Japanese-Americans represented a small security threat."
