Summary of Case:

"Steven N. Korossy was wrongly convicted on November 18, 2016 of five misdemeanor counts of attempted unauthorized use of property in Lucas County, Ohio. Korossy's prosecution was based on the allegation that between November 2013 and January 2015 while he was working as a Put-In-Bay, Ohio police officer, he repeatedly accessed the Ohio Law Enforcement Gateway database without authorization. Steven Korossy was indicted on July 15, 2015 for 14 felony counts of unauthorized use of property, but he agreed to a deal to plead no contest to reduce the charges to misdemeanors and a much lesser sentence. During a hearing in May 2016 Korossy changed his plea from not guilty to no contest, and with Korossy's consent the judge found him guilty. On August 15, 2016 Korossy was sentenced to 30 days in the Ottawa County Detention Facility on each count, with the sentences to be served consecutively, for a total of 150 days in jail, with half suspended. His sentence was stayed pending his appeal of the judgment of conviction that was filed on November 18, 2016. One of Korossy's arguments was that the finding of guilt was flawed because the judge did not elicit a recitation of the facts from the prosecution that support his guilty all of the elements of the offense, before accepting his no contest plea. On August 18, 2017 the Ohio 6th District Court of Appeals reversed Korossy's convictions “Because the trial court erred in making a finding of guilt without eliciting an explanation of the circumstances, and because double jeopardy attached, prohibiting a new determination of guilt or innocence, we find Korossy’s first and fourth assignments of error well-taken." [Ohio v. Korossy, No. OT-16-025 (Ohio 6th Dist Ct of Appeals, 8/18/2017)] Korossy's retrial was barred by double jeopardy."
