Summary of Case:

"Dwight Labran was wrongly convicted of first-degree murder in New Orleans. The prosecution's case was based on the testimony of a single eyewitness who was the owner of the car in which the body was found. Labran's alibi defense was that at the time of the murder he was eating dinner with family members in a restaurant on the other side of New Orleans. After the jury convicted him they could not agree on whether he should be sentenced to death, so he was sentenced to life in prison without parole. A post-conviction investigation by the Innocence Project of New Orleans discovered the prosecution failed to disclose that at the time of his identification of Labran the witness had outstanding warrants for firearms and drug offenses that were dismissed after he testified. Based on the prosecution's Brady violation Labran was awarded a new trial and after the Orleans DA's Office declined to reprosecute Labran the charges were dismissed and he was released on December 10, 2001. Labran's wrongful murder conviction expunged on January 16, 2003."
