Summary of Case:

"Edward Larkman was wrongly convicted of the August 12, 1925 murder of a man in Buffalo, New York based on the testimony of a single eyewitness. Larkman was sentenced to death. Larkman's direct appeal was denied by New York's Court of Appeals, but there were two dissenters who argued Larkman's identification by the witness had not been established beyond a reasonable doubt. Based on those dissenters New York Gov. Alfred E. Smith cummuted Larkman's sentence to life in prison on January 13, 1927, only 10 hours before his scheduled execution. In April 1929 Anthony Kalkiewicz, who had been arrested for another crime, confessed that he and four other men had committed the murder and Larkman hadn't been involved. Based on the new evidence of Larkman's innocence, New York Gov. Herbert Lehman unconditionally pardoned Larkman on April 18, 1933, and he was released after 7-1/2 years imprisonment."
